Functions and Responsibilities
The Regulatory and Documentation Sector (SND) has the following responsibilities:
Support for the process of drafting and implementing MERCOSUR regulations.
- Analyze the formal aspects of draft regulations and proposals submitted by technical forums for consideration by MERCOSUR decision-making bodies, and prepare Correction Proposals, when applicable.
- With the support of the SAP, review the Spanish and Portuguese versions of draft regulations to ensure their effective correspondence before submission to decision-making bodies.
- With the support of the SAP, review the Spanish and Portuguese versions of approved regulations to detect possible formal errors and propose Errata Sheets, when applicable.
Monitoring the process of incorporating MERCOSUR regulations into the legal systems of the Member States
- Record notifications from the Member States regarding the incorporation of MERCOSUR regulations into their national legal systems.
- Notify the Member States when the process of incorporating MERCOSUR regulations into the legal systems of all Member States has been completed.
- Keep updated lists of the status of incorporation of MERCOSUR regulations in the Member States.
- Compile national regulations through which the Member States incorporated MERCOSUR regulations into their respective national legal systems.
- Keep updated lists of Agreements, Protocols, Decisions, Resolutions, Directives, and Recommendations, as well as of draft regulations submitted by technical forums for consideration by MERCOSUR decision-making bodies.
Assistance in MERCOSUR Dispute Settlement Procedures
- Record the lists of arbitrators and experts provided for in MERCOSUR Dispute Settlement and Claims Procedures, as well as those established in agreements signed by MERCOSUR with third countries, groups of countries, and international organizations.
- Perform other tasks assigned in MERCOSUR Dispute Settlement and Claims Procedures, as well as in dispute settlement proceedings agreed upon between MERCOSUR and third countries or groups of countries.
Archiving
- Organize, systematize, and keep updated MERCOSUR’s official archive, which must include all documentation issued by MERCOSUR’s institutional bodies, as well as all instruments signed by MERCOSUR with third countries, groups of countries, or international organizations.
- Maintain the SM Database structured to allow queries by topic, issuing body, or type of regulation.
- Cross-check physical and digital versions of minutes and annexes, and in case of discrepancies, correct the digital version accordingly.
- Archive the national regulations through which the Member States incorporated MERCOSUR regulations into their respective national legal systems.
Support services for negotiation processes:
- Prepare support documents, monitoring tools, and lists detailing the work of the bodies within the institutional structure: follow-up on Annual Work Programs and their degree of completion, Institutional Structure, Working and Information Documents, number of meetings, document dossiers, among others.
- Prepare a regulatory dossier on a specific subject.
- Provide support to MERCOSUR body meetings.
Other tasks
- Prepare the content of the MERCOSUR Official Gazette.
- Handle inquiries about MERCOSUR documentation and regulations.
- Select all public documentation issued by MERCOSUR’s institutional bodies for inclusion on the website.
